§ 1 Scope
These General Terms and Conditions (T&C) govern the use of the gratis.immo platform, operated by Athius da Cruz Mendes, Im Lutzfeld 28, 9493 Mauren, Liechtenstein (hereinafter "Operator"). By using the platform, the user accepts these T&C.
Deviating terms of the user are not recognised unless the Operator expressly agrees to their validity in writing.
§ 2 Platform services
gratis.immo provides an online platform on which users can publish and search real estate listings free of charge. The Operator acts solely as a technical intermediary and does not become a contracting party between advertisers and interested parties.
Use of the platform is free for advertisers and seekers. The Operator finances the platform through advertising. There is no claim to constant availability of the platform; maintenance work or technical faults may lead to interruptions.
§ 3 Registration and user account
Registration is required to create listings. The user undertakes to provide truthful information and to keep their access data secret. Passing the account on to third parties is not permitted.
The user may delete their account at any time. Upon deletion, personal data is anonymised; already anonymised market data pursuant to § 6 remains unaffected by this.
§ 4 Advertiser obligations
Advertisers are solely responsible for the listings they post. By posting a listing, the advertiser confirms that they are authorised to publish it and that the information is truthful and complete.
The advertiser undertakes in particular not to post any content that:
- violates applicable law or the rights of third parties,
- contains false, misleading or incomplete information about the property,
- advertises third-party properties without authorisation,
- uses copyright-protected images or texts of third parties without permission,
- contains offensive, discriminatory or objectionable content.
§ 5 Review and removal of listings
The Operator reviews listings before publication but assumes no guarantee for their accuracy or legality. The Operator is entitled to remove or not approve listings that violate these T&C or applicable law without prior notice.
In the event of repeated or serious violations, the Operator may block or delete the user account.
§ 6 Use of anonymised market data
The user acknowledges and agrees that the Operator creates anonymised and aggregated market data from the listings and search queries published on the platform. This data does not allow any conclusions to be drawn about individual persons.
The Operator is entitled to use this anonymised, aggregated market data for analysis purposes and to pass it on or sell it to third parties, in particular financial institutions. Details on data processing are set out in the Privacy Policy.
§ 7 Granting of rights
The advertiser grants the Operator the non-exclusive right, limited in space and time to the duration of publication, to store, reproduce and make publicly accessible the posted content (texts, images) for the purpose of display on the platform. Ownership and copyright remain with the advertiser.
§ 8 Liability
The Operator is not liable for the accuracy, completeness or legality of listings posted by users. Contracts regarding properties are concluded exclusively between advertiser and interested party; the Operator is not involved in these and assumes no liability for their conclusion or fulfilment.
The Operator is only liable for damages based on intentional or grossly negligent conduct. Liability for slight negligence is excluded to the extent permitted by law.
§ 9 Changes to the T&C
The Operator reserves the right to change these T&C at any time with effect for the future. Registered users will be informed of material changes. Continued use of the platform after the changes take effect is deemed consent.
§ 10 Final provisions
The law of the Principality of Liechtenstein applies, excluding the conflict-of-law rules of international private law. The place of jurisdiction is, to the extent permitted by law, the Operator's registered office.
Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected.
